We at Layerise ApS and our affiliates and subsidiaries (Layerise,” Company“, we,” “us,” or “our”) are committed to protecting the privacy and security of the personal information you provide to us. Please read this Applicant Privacy Notice (the “Privacy Notice”) to learn how we collect and process your personal information when you apply for a job or other role with us. As a job applicant, you have the right to know and understand the categories of personal information we collect about you, and the purposes for which we use such personal information. The Company does not sell or otherwise disclose this personal information for monetary or other consideration to any third parties.

Collected Personal Data

Layerise may collect the following general personal data:

  • First and Lastname (Full Name)
  • E-mail address
  • Phone number
  • Any information you provide, as information supplied in the provided CV, cover letters or any other document shared with the application
  • Work/Employment history
  • Legal work documentation (e.g. work permit, visa)
  • Competence, personal and professional assessment results
  • Current salary information
  • Expected salary information
  • Personal data provided about you during our reference check

Sources of Personal Data

We collect personal information you voluntarily provide to us when you apply for a job or otherwise contact us in the recruitment context. If you are visiting our website or online job application, we may also automatically collect device information such as device identifiers. For example, we may collect information from:

  • Recruiters
  • Prior employers (e.g., for references)
  • Professional references you provide to us
  • Pre-employment screen services
  • Publicly available sources such as your social media profile (e.g., LinkedIn and Twitter)

Usage of Personal Data

We use the personal data listed above for the following purposes:

  • Assess your suitability for the position
  • Process and manage you application
  • Conduct reference and background checks (if applicable)
  • Check your entitlement to work in the country you have applied for
  • Record-keeping
  • Meeting legal requirements and enforcing legal terms

Record keeping/Storage

We keep your application and any other data you have provided to us throughout the hiring process. Your personal data may be kept in our records for a longer period of time if you wish to be considered for further job vacancies, provided that you have given your prior consent. Under no circumstances, we do not keep any records of your data for longer than 1 year.

Disclosure of Personal Data

We may share your personal data as necessary for the purposes described in this Privacy Notice, including internally with our personnel involved in the hiring process. For example, we share your personal data with the following parties:

  • Affiliates: We may share your personal data with third parties who assist us in the hiring process.
  • Service Providers: We may use service providers to operate, host and facilitate our hiring and recruitment process. These include hosting, technology and communication providers; analytics providers; background and reference check screening services; and hiring process management tools.
  • Government authorities: Your personal data may be shared if we are required to do so in order to comply with the law or court order..
  • Business transfers: Your personal data may be transferred to a third party if we undergo a merger, acquisition, bankruptcy or other transaction in which that third party assumes control of our business (in whole or in part).
  • Professional advisors: We may share your personal information with our professional advisors.

Data Transfers

Layerise may transfer your personal data to a third country outside the EU/EEA, that is not regarded as ensuring an “adequate” level of protection for personal data. In connection with such transfers Layerise will establish an adequately protection to an appropriate level. Such adequately protection level is currently ensured through the EU standard contractual clause.

Your Rights

GDPR gives you certain rights with respect to your Personal Data being processed by Layerise, however under certain circumstances some rights are subject to limitation:

  • Access: You can request more information about the Personal Data we hold about you and request a copy of such Personal Data.
  • Rectification: If you believe that any Personal Data we are holding about you is incorrect or incomplete, you can request that we correct or supplement such data.
  • Erasure: You can request that we delete some or all of your Personal Data from our systems.
  • Withdrawal of Consent: If we are processing your Personal Data based on your consent (as indicated at the time of collection of such data), you have the right to withdraw your consent at any time. Please note, however, that if you exercise this right, you may have to then provide express consent on a case-by-case basis for the use or disclosure of certain of your Personal Data.
  • Portability: You can ask for a copy of your Personal Data in a machine-readable format. You can also request that we transmit the data to another controller where technically feasible.
  • Objection: You can contact us to let us know that you object to our applicable legal grounds for the further use or disclosure of your Personal Data for certain purposes, such as for direct marketing purposes.
  • Restriction of Processing: You can ask us to restrict further processing of your Personal Data.
  • Right to File Complaint: You have the right to lodge a complaint about Company’s practices with respect to your Personal Data.

Please note that in some circumstances, we may not be able to fully comply with your request, such as if it is frivolous or extremely impractical, if it jeopardizes the rights of others, or if it is not required by law, but in those circumstances, we will still respond to notify you of such a decision. In some cases, we may also need you to provide us with additional information, which may include Personal Data, if necessary to verify your identity, your European residency and/or the nature of your request. We may be unable to process your request if you do not provide us with sufficient detail to allow us to understand and respond to it.
